But the Department of Veterans Affairs sought to calm fears by pledging to cover additional costs while waiting for President Obama to act on a bill that would keep VA funding fees in place thru mid-November.&lt;br /&gt;&lt;br /&gt;The fees are mandatory charges applied to every VA purchase and re-finance loan. They help keep the program running and help ensure service members can continue to purchase a home with no money down or private mortgage insurance. The bill now is awaiting the presidents signature and would stave off the rate drop until Nov. 17.&lt;br /&gt;&lt;br /&gt;Government officials expect the VA funding fee issue to be resolved within days. This new act states a power of attorney must be signed by the principal and two subscribing witnesses and be acknowledged by the principal before a notary public. &lt;br /&gt;&lt;br /&gt;Floridians are being warned that if they don't comply with the new laws there power of attorney will be invalid. Power of attorney's that were entered prior to 10-1-11 will still be valid if they followed the current laws that were in place at that time. Also the NFIP provides disaster relief funds to states effected by hurricane Irene.&lt;br /&gt;&lt;br /&gt;If this program expires new home loan applicants requiring flood insurance would be held up pending extension of the program. Other bills floating around congress seek to extend the program for five more years. The current down payment for an FHA mortgage is 3.5% and they want to increase this to 5%. The FHA Rural Regulatory Improvement Act of 2011 would also prevent borrowers from rolling the closing costs into the loan. This would severely limit first time home buyers. &lt;br /&gt;&lt;br /&gt;Representatives of the Mortgage Bankers Assoc (MBA), National Assoc of Realtors(NAR), and the National Assoc of Home Builders(NAHB) all have testified opposing this new legislation. This draft legislation does not have a bill number yet but is presently being reviewed and debated. Also it takes weeks to get the dispute removed and that can kill the loan process.&lt;br /&gt;&lt;br /&gt;On April 1st the Dodd-Frank Financial Reform Bill was passed. This caps the amount loan officers can earn per loan transaction. In 2003 HUD issued a rule that prohibited FHA from insuring mortgages on homes that were owned by the seller for less than 90 days. In February 2010 HUD lifted the ban for one year, they just extended the wavier until January 2012. &lt;br /&gt;&lt;br /&gt;This rule was designed to avoid flipping properties-buying and quickly re-selling the property to borrowers at an inflated price. But it made me wonder if this is where the notary office is going in the future. I don't see how you can properly identify and individual over a web cam and also you cant see anything going on outside of the viewing window, what if they are being coerced in some way. With the federal deficit of $13 trillion officials are trying to find ways to curb this growing debt. &lt;br /&gt;&lt;br /&gt;This deduction has been a strong incentive for home ownership since 1913. Americans have been able to deduct the interest paid on mortgages for there primary residences, second homes and home equity lines of credit for over 100 years. According to HUD the wording has been changed to include new statutory authority to penelize for false certifications or fraudulant activities and new language for sellers of a HECM  for purchase transactions.&lt;br /&gt;&lt;br /&gt;On the day of closing the HECM mortgagor must certify the source of cash used for the investment or that the closing costs were not paid by the seller or any other person that will financially benefit from this transaction. Any applications taken 1-1-10 and after are required to use the new forms. The new GFE is pretty much unchanged. The new HUD is longer and has more information but is easier for the borrowers to compare closing costs. The first page is the same, the 2nd page after each charge is listed the line # for the corresponding item from the GEF appears. Line 1101 will show the total of the charges reflected in the 1100 series. The same for line 1201 and 1301. The fees will be broken down for that section. The 3rd page compares GFE and HUD charges at the top. The bottom of page 3 goes over all the loan terms. You may ask why would I need safety tips, but if you are traveling to rural areas late at night or sometimes it could be the house around the corner you may find yourself in a precarious situation. Sometimes borrowers may have alot riding on that particular transaction going through. Here are some things that would stop a signing in its tracks. In-valid forms of identification, one spouse forcing another spouse to sign, or wanting to sign for the absent spouse, an elderly person being forced by another family member to sign a document they cant physically sign or don't understand. &lt;br /&gt;You may be able to deter some of these situations by confirming ahead of time the type of identification required, and who needs to be present to sign the documents.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;You may be pressured by the signers to perform an illegal notarization but you must follow your notary laws and code of ethics.If you need to terminate the signing handle with care. Here are some tips to keep you safe:&lt;br /&gt; &lt;br /&gt;1. Always leave a log sheet at the office showing the addresses you will be at that day  and make sure someone knows where you keep it.&lt;br /&gt; &lt;br /&gt;2. Have your cell phone with you at all times.&lt;br /&gt; &lt;br /&gt;3. When you arrive at the signing be aware of your surroundings, take note of all exits, dogs, other people in the house. &lt;br /&gt; &lt;br /&gt;4. If at anytime you need to stop the signing ,call the company that hired you to confirm you halted the signing and if you need keep them on the phone with you while you vacate the property. They can alert police if you need help.&lt;br /&gt; &lt;br /&gt;5. If the final TIL does change then there is an additional 3 business day waiting period until close. If the new TIL is mailed the waiting period is 6 business days. I have heard of several cases where the borrowers were not informed of all of there loan terms. It is my job as a Certified Signing Agent to make sure that the borrowers understand there loan documents and if there are any questions I can not answer the loan oficer is called. &lt;br /&gt;&lt;br /&gt;When I arrive at a signing one of the first steps I take is to go over all the important terms to make sure it is what the borrower has agreed to. We check the loan amount, funds I am to collect, the interest rate, whether it is a fixed rate loan or an adjustable rate, any prepayment penalties, payment amount and any escrowed items. If everything is correct then we proceed with the signing.&lt;br /&gt;&lt;br /&gt;I  heard that some states have tried to bar notary's from performing loan signings, but I think this would be a terrible mistake. I get paid whether the borrowers sign the documents or not so I would not loose hundreds or thousands of dollars just because the loan fell through.I One of my primary roles is to make sure the borrowers understand there loan terms.&lt;br /&gt;&lt;br /&gt;I think Certified Signing Agents should be used for all loan transactions. The IRS has announced that they will boost the standard mileage tax deduction for the second half of 2008. The mileage rate was 50.5 cents after July 1, 2008 the rate was increased to 58.5 cents per mile of business travel.&lt;br /&gt;&lt;br /&gt;Every little bit helps us small business owners. So remember that when you are having your 2008 taxes prepared that they give you the extra mileage increase for the 2nd half of the year. A "notarius" was appointed as a public official to create written documents of agreement or wills and hold them for safekeeping.&lt;br /&gt;&lt;br /&gt;Wax seals with engravings or symbols were used as signatures. In later centuries, ribbons were woven into the margins of multiple page documents to tie the pages together. Wax seals were placed over the knots to ensure no pages were added or removed. This was the begining of the notary seal and certificate. &lt;/div&gt;&lt;br /&gt;&lt;div&gt;&lt;/div&gt;&lt;br /&gt;&lt;div&gt;Just wanted to give everyone a little history into the notary public office. When loan closing assignment is received, first verify with the lender or title company all of the specifics of the closing. There may be documents that you are to pick up, certified funds to collect, and copies of drivers license. Verify what color of ink you should use for the signing and what address and account # should be used for the returning of the documents.&lt;br /&gt;&lt;br /&gt;2. Immediately call borrower to confirm the time, date, and location of the closing. Advise borrower of any documents or funds you need to collect. Verify that he or she has proper identification and will have copies available for you to collect.&lt;br /&gt;&lt;br /&gt;3. When loan package is received print out 2 copies 1 to sign and 1 for borrower to keep for there records. Review all documents for special instructions, pages that did not print correctly, or names that are misspelled. Also check settlement statement to verify funds to collect.&lt;br /&gt;&lt;br /&gt;4. Call borrower before leaving for appointment to ensure he or she has everything ready for you to collect and the certified funds are for the correct amount.&lt;br /&gt;&lt;br /&gt;5. Be on time! Always leave 10 to 15 minutes early for appointment encase you run into any traffic or have trouble locating address.&lt;br /&gt;&lt;br /&gt;6. Verify the borrower has proper identification and the correct certified check for you. Review and sign each document with the borrower, make sure to sign as witness and fill out all notarizations. Don’t leave any blanks. If the borrower has any questions you are un-able to answer call the loan officer or lender.&lt;br /&gt;&lt;br /&gt;7. Double check all dates, signatures, and notarizations before leaving the table. Make sure you have the certified funds and any copies you were to collect.&lt;br /&gt;&lt;br /&gt;8. When signing is complete make sure to give the borrower a copy of the loan package, have he or she sign your notary journal.&lt;br /&gt;&lt;br /&gt;9. Promptly fax any required documents and drop off package immediately to ensure the documents are received by the next business day if possible.&lt;br /&gt;&lt;br /&gt;10. Call or e-mail the title company and lender with the status of the signing, return tracking # and the date they should receive package.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;If you follow my 10 easy steps then you should have a successful signing.
